These terms are an agreement between you (the business subscribing to Kello) and NextWave Tech Inc., operating as Kello ("we", "us"). By creating a Kello account — including by text message — you agree to them. We've written them in plain language on purpose.
Kello is an AI-powered receptionist service. It answers phone calls and text messages to your Kello number on behalf of your business: it can answer questions from information you provide, book and manage appointments, take messages, send texts (confirmations, reminders, summaries), and — if you enable payments — send invoices and collect payments from your customers.
Kello is artificial intelligence, and AI can make mistakes. Like a human receptionist — but in its own ways — Kello can occasionally mishear a caller, misunderstand a request, or give an answer that isn't right. We build in safeguards: it only answers from the business facts you give it, it confirms bookings by text, it flags answers it wasn't sure about in your call summaries, and it hands difficult calls to you. But you should not rely on Kello for anything where a mistake would cause serious harm, and you should review your call summaries. By using Kello you accept that occasional AI errors are part of the service.
Kello numbers are not a replacement for emergency services and cannot place 911 calls for you or your callers. Do not present your Kello number as an emergency line. If a caller has an emergency, they should hang up and dial 911.
Your Kello number is provisioned for your use while your account is active. Numbers remain part of Kello's carrier account; if you cancel, we'll cooperate with a port-out request where the carrier supports it.
Don't use Kello for anything unlawful, deceptive, or harmful — including spam, harassment, or impersonating another business. We can suspend accounts that do, or that put the platform's phone numbers and carrier relationships at risk.
We work hard to keep Kello answering around the clock, and we've built in failover: if our answering system is ever unreachable, incoming calls are forwarded to your own phone rather than ringing out. Still, no phone or AI service can promise 100% uptime, and Kello is provided "as is" without warranties of uninterrupted or error-free operation.
To the maximum extent the law allows: Kello's total liability for any claim arising out of the service is limited to the fees you paid us in the three (3) months before the event giving rise to the claim. We are not liable for indirect or consequential losses — including lost profits, lost bookings, or missed opportunities — whether arising from AI errors, missed or dropped calls, message delivery failures, or third-party outages (carriers, AI providers, payment processors). Nothing in these terms limits liability that cannot be limited under applicable law.
You can close your account anytime by texting Kello. We can suspend or close accounts for breach of these terms with notice where practical. On closure we stop answering your number and handle your data as described in our Privacy Policy.
If we change these terms materially, we'll text you before the change takes effect. These terms are governed by the laws of Alberta and the federal laws of Canada. Questions: hello@kello.ca.
